I will sell at public auction to highest bidder at County Court House on 06/03/2024 at 11:00 a.m. the following property: All that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Greenville, containing 1.17 acres, more or less, containing Lot W-9 and portions of Lots W-8 and W-10, of Carolina Springs, formerly known as "Whippoorwill," as shown on "Plat for Whippoorwill Development Company, Inc." prepared by Enwright Associates, Engineers dated November 17, 1971, and recorded in the Office of the Register of Deeds for said County in Plat Book 4L, at Page 151. Said property is more specifically shown as "Survey for Shirley Byars Jenkins, Part of Lot W-9 and Part of Lots W-8 and W-10, Carolina Springs" prepared by Freeland-Clinkscales and Associates, Inc. Engineers and Land Surveyors, on July 31, 1991, and recorded in the Office of the Register of Deeds for said County in Plat Book 20W at Page 51. Reference to said plats being hereby made for a more complete metes and bounds description thereof. Less and except property (0.053 acre) conveyed to the Greenville Legislative Delegation Transportation Committee by deed dated November 30, 2007 and recorded January 15, 2008 in Book 2308 at Page 2267 in the Office of the Clerk of Court/Register of Deeds for Greenville County. Please note that the above legal description has been modified to correct a minor, immaterial clerical error regarding the encumbered Lots, the name of the survey dated July 31, 1991 and to add the less and except property. This being the same property conveyed to Vincent Lynn Davis by deed of Shirley B. Stokes dated August 26, 2022 and recorded September 1, 2022 in Book 2667 at Page 3173 in the Office of the Clerk of Court/Register of Deeds for Greenville County. Thereafter, Vincent Lynn Davis conveyed the subject property to Beach Mountain Holdings, LLC by deed dated September 7, 2023 and recorded September 29, 2023 in Book 2700 at Page 1531 in the Office of the Clerk of Court/Register of Deeds for Greenville County. TMS map: 0555040101100

The total judgment debt set forth in the Order is $383,573.84.

This property will be sold subject to any past due or accruing Property taxes, assessments, existing easements and restrictions of record and any other senior encumbrances.

This property will be sold subject to the following mortgage(s)/ senior encumbrances: NONE

The successful bidder must pay interim interest from the date of the Sale through date of compliance at the rate of 6.250%.

Each successful bidder other than plaintiff at time bid is accepted will be required to deposit with Master as evidence of good faith 5% of bid in cash or certified check at the time of bid. In event purchaser fails or refuses to comply with terms of sale within 20 days from close of bidding, deposit shall be forfeited and applied first to costs and then to Plaintiff's debt, and the Master shall forthwith re-advertise and resell said property upon the same terms on some subsequent sales day at the risk of former purchaser until obtaining full compliance with sale.
