I will sell at public auction to highest bidder at County Court House on 02/05/2024 at 11:00 a.m. the following property: All that piece, parcel or tract of land situate, lying and being in the County of Greenville, State of South Carolina, with all improvements thereon or hereafter constructed thereon, being know and designated as 2.1446 acres, more or less, as shown on plat entitled "Boundary & Topographic Survey for Hallmark Real Estate" prepared by Freeland-Clinkscales & Associates, dated June 15, 1989, and recorded in the ROD Office for Greenville County in Plat Book 17-H at Pages 29 and 30, reference to said plat being craved for metes and bounds description thereon. ALSO, all that piece, parcel or tract of land situate, lying and being in the County of Greenville, State of South Carolina, being known and designated as a 24' Fire Access Easement as shown on plat entitled "Fire Access Easement for Hallmark Real Estate" dated June 20, 1989, prepared by Freeland-Clinkscales & Associates, and recorded in the RMC Office for Greenville County in Plat Book 17-1 at Page 42, reference to which is craved for metes and bounds description. LESS & EXCEPT, all that parcel or strip of land, in fee simple, containing 8,897 square feet (0.204 acre), more or less, and all improvements, thereon, if any, owned by Patriot Living, LLC, a South Carolina limited liability company, d/b/a Southern Oaks, shown as the "Area of Acquisition" on Exhibit A, attached to that certain Consent Order of Dismissal in that certain action styled SC Department of Transportation v. Patriot Living, LLC, a South Carolina limited liability company, d/b/a Southern Oaks, C.A. No. 2017-CP-23-05835, and filed on February 21, 2020 in Deed Book 2587 at Page 5824 in the Office of the ROD for Greenville County, South Carolina, between approximate survey stations 23+00 and 26+00 on the right of S- 547. Property herein conveyed is along a relocated centerline as shown on plans between approximate survey stations 9+77.06 and 61+32.67. This is the same property conveyed to Patriot Living, LLC by Deed of Eastside Manor, Inc., dated April 27, 2015 and recorded May 1, 2015 in Deed Book 2464 at Page 3195 in the Office of the ROD for Greenville County, South Carolina.TMS map: 0543.01-01-001.11

The total judgment debt set forth in the Order is $780,633.93.

The successful bidder must pay interim interest from the date of the Sale through date of compliance at the rate of 11.50%.

Each successful bidder other than plaintiff at time bid is accepted will be required to deposit with Master as evidence of good faith 5% of bid in cash or certified check at the time of bid. In event purchaser fails or refuses to comply with terms of sale within 20 days from close of bidding, deposit shall be forfeited and applied first to costs and then to Plaintiff's debt, and the Master shall forthwith re-advertise and resell said property upon the same terms on some subsequent sales day at the risk of former purchaser until obtaining full compliance with sale.

Additional Bidder Requirements:

Bidding will not close on sales day, but will remain open for a period of 30 days to close on 03/06/2024 at 11:00 A.M. THE PLAINTIFF RESERVES THE RIGHT TO WAIVE DEFICIENCY UP TO AND INCLUDING THE DATE OF THE SALE.
