I will sell at public auction to highest bidder at County Court House on 08/05/2024 at 11:00 a.m. the following property: ALL THOSE PIECES, PARCELS OR LOTS OF LAND, WITH ANY IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN GREENVILLE COUNTY, SOUTH CAROLINA, BEING SHOWN AS LOTS # 7 AND # 8 OF ALBANS ACRES, A PLAT OF WHICH IS RECORDED IN PLAT BOOK 4N AT PAGE 31, AND ACCORDING TO SAID PLAT, HAVING THE FOLLOWING METES AND BOUNDS, TO WIT: BEGINNING AT AN IRON PIN ON THE NORTHEASTERLY SIDE OF FORKS SHOALS ROAD AT THE JOINT FRONT CORNER OF LOTS # 6 AND # 7 AND RUNNING THENCE WITH THE LINE OF SAID LOTS, N 69-41 E. 450.7 FEET; THENCE N 19-09 W. 190 FEET; THENCE S 69-41 W. 450.7 FEET TO AN IRON PIN ON FORKS SHOALS ROAD; THENCE WITH FORKS SHOALS ROAD, S 19-09 E. 190 FEET TO THE POINT OF BEGINNING. THIS BEING THE SAME PROPERTY CONVEYED TO ALFRED M. SWEENEY BY DEED OF W.R. JULIAN, AS TRUSTEE FOR JOHN R. JULIAN AND BERNICE E. JULIAN, DATED FEBRUARY 29, 1972, AND RECORDED MARCH 6, 1972, IN BOOK 937 AT PAGE 497 IN THE OFFICE OF THE REGISTER OF DEEDS FOR GREENVILLE COUNTY, SOUTH CAROLINA. THEREAFTER, ALFRED M. SWEENEY CONVEYED AN UNDIVIDED ONE-HALF (1/2) INTEREST IN THE SUBJECT PROPERTY TO WAYNE E. SWEENEY BY DEED DATED MARCH 2, 2004, AND RECORDED ON MARCH 11, 2004, IN BOOK 2078 AT PAGE 1721 IN SAID RECORDS. SUBSEQUENTLY, ALFRED M. SWEENEY PASSED AWAY ON OR AROUND JULY 5, 2004, LEAVING HIS INTEREST IN THE SUBJECT PROPERTY TO HIS DEVISEES, WAYNE SWEENEY AND GARNETT SWEENEY, AS IS MORE FULLY PRESERVED IN ESTATE FILE 2004-ES-32-01253. The total judgment debt set forth in the Order is $27,943.26.

This property will be sold subject to any past due or accruing Property taxes, assessments, existing easements and restrictions of record and any other senior encumbrances.

This property will be sold subject to the following mortgage(s)/ senior encumbrances: Attention is specially called to the encumbrance held by Wells Fargo Bank, N.A. against Wayne Sweeney recorded on July 21, 2006 in Book 4609 at Page 1469 and being in the original amount of $133,600.00.

The successful bidder must pay interim interest from the date of the Sale through date of compliance at the rate of 9.99 %.

Each successful bidder other than plaintiff at time bid is accepted will be required to deposit with Master as evidence of good faith 5% of bid in cash or certified check at the time of bid. In event purchaser fails or refuses to comply with terms of sale within 20 days from close of bidding, deposit shall be forfeited and applied first to costs and then to Plaintiff's debt, and the Master shall forthwith re-advertise and resell said property upon the same terms on some subsequent sales day at the risk of former purchaser until obtaining full compliance with sale.

Additional Bidder Requirements:

Bidding will not close on sales day, but will remain open for a period of 30 days to close on 09/04/2024 at 11:00 A.M. THE PLAINTIFF RESERVES THE RIGHT TO WAIVE DEFICIENCY UP TO AND INCLUDING THE DATE OF THE SALE.

Terms of sale - cash; purchaser to pay for deed and stamps.

Additional Terms of sale: In the event an agent of Plaintiff does not appear at the time of sale, the within property shall be withdrawn from sale and sold at the next available sales date upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or such terms as may be set forth in a supplemental order.

Attention is drawn to the Court Order on file with the Clerk of Court for Greenville County. The terms and conditions of the actual Court Order, to the extent of any inconsistencies, control over any terms or conditions contained in the Notice of Sale.
