I will sell at public auction to highest bidder at County Court House on 08/07/2023 at 11:00 a.m. the following property: All that certain piece, parcel or lot of land, with all improvements thereon, or hereafter constructed thereon, situate, lying and being in the State of South Carolina, County of Greenville, on the Southwestern side of a Frontage Road on the right-of way of U.S. Highway 276 at the intersection thereof with Brentwood Way, being shown and designated as Lot No. 65 on a plat of Brentwood, Section I, made by Piedmont Engineers and Architects, Surveyors, dated February 15, 1972, recorded in the RMC Office for Greenville County, South Carolina, in Plat Book 4N, at Page 62, and having, according to said plat, the following metes and bounds, to-wit: Beginning at an iron pin on the Southwestern side of Frontage Road at the corner of property owned by Jeff R. Richardson, Jr., Trustee and running thence along the line of said property S. 70-57 W. 120.1 feet to an iron pin; thence S. 27-18 E. 135.3 feet to an iron pin on Brentwood Way; thence along the Northern side of Brentwood Way N. 62-54 E. 112 feet to an iron pin; thence with the curve of the intersection of Brentwood Way with Frontage Road, the chord of which is N. 13-28 E., 32.5 feet to an iron pin on Frontage Road; thence along the Southwestern side of Frontage Road N. 36-00 W. 95 feet to an iron pin, the beginning corner. This being the same property conveyed to Latitia G. Montgomery by deed of Rackley, Builder-Developer, Inc. dated November 29, 1972 and recorded December 1, 1972 in Book 962 at Page 31 in the Office of the Clerk of Court/Register of Deeds for Greenville County. Thereafter, Latitia G. Montgomery conveyed a one-half interest in the subject property to J.L. Montgomery, III by deed dated May 21, 2007 and recorded May 31, 2007 in Book 2270 at Page 291 in the Office of the Clerk of Court/Register of Deeds for Greenville County. Thereafter, Mary Latitia Gray Montgomery died intestate on January 31, 2021, leaving the subject property to her devisees, namely Joseph Lanham Montgomery, III, Meredith Latitia Montgomery Kinard, Valerie Grace Montgomery Bridges, and John Justin Montgomery, by Deed of Distribution for Probate Estate File Number 2022-ES-23-00391, dated May 11, 2022 and recorded June 6, 2022, in Book 2659 at Page 2444 in the Office of the Clerk of Court/Register of Deeds for Greenville County. Thereafter, Joseph Lanham Montgomery, III a/k/a J.L. Montgomery, III a/k/a Lanny Montgomery died intestate on November 16, 2021, leaving the subject property to his heirs, namely Meredith Montgomery Kinard, Valerie Montgomery Bridges, and John Justin Montgomery as shown in Probate Estate Matter Number 2022-ES-23-00729. The total judgment debt set forth in the Order is $71,700.38.

Each successful bidder other than plaintiff at time bid is accepted will be required to deposit with Master as evidence of good faith 5% of bid in cash or certified check at the time of bid. In event purchaser fails or refuses to comply with terms of sale within 20 days from close of bidding, deposit shall be forfeited and applied first to costs and then to Plaintiff's debt, and the Master shall forthwith re-advertise and resell said property upon the same terms on some subsequent sales day at the risk of former purchaser until obtaining full compliance with sale.
